These conditions of use describe how BotenUnie works, what responsibility you have as a user and what you can expect from the platform. Read them before creating an account, offering a boat or sending a purchase or rental request.
1. Applicability and character of the platform
BotenUnie.com is currently a privately managed project for publishing and finding boat advertisements. The platform can be used by private and professional providers. It is currently focused on advertisements, contact options and information; on the website are not by BotenUnie online purchase or rental payments or final reservations made. The terms and conditions relate to the use of the website and do not automatically constitute the purchase or rental agreement between users.
2. Accounts and access
Certain parts require an account. When registering you must provide correct and up-to-date data. You are responsible for carefully storing your login details and for activities within your account, unless the abuse cannot be attributed to you. Don’t share your password with others. Report abuse or loss of access as soon as possible via Contact.
Do not create accounts on behalf of others without permission. Do not use the website to circumvent security, access other people’s accounts, or cause automated excessive traffic. We may take appropriate measures, including control, temporary restriction or removal of harmful content, if there is reasonable suspicion of abuse.
3. Post and modify ads
You may only offer a boat if you are authorized to do so. An advertisement must be as complete, current and correct as possible. Provide relevant information on type, make, model, year of construction, location, asking or rental price, technical condition and known major defects. Use your own or legally obtained photographs and texts. Do not publish misleading availability, unauthorised personal data or prohibited content.
A submitted or modified ad may be moderated in advance. Publication, duration and order of visibility shall be determined by the establishment of the platform. An advert is not a guarantee of reactions or a successful sale or rental. When a boot is no longer available, you need to update or delete the ad.
4. Private and business providers
A provider shall be responsible for the proper designation of its own capacity. The rights of the interested party may vary where a provider acts professionally or in a business manner. Any legal information, consumer and warranty obligations of a professional provider continue to apply, even when an agreement is made through an advertisement. BotenUnie cannot exclude such legal rights.
5. Contact, purchase requests and rental applications
Visitors can send a message or request to a provider via the website. An application about availability, a desired rental period or number of persons is no automatically confirmed reservation, booking or payment. The provider and the interested party shall directly agree whether to proceed and under what conditions. Do not disclose payment details or confidential documents via a public message.
Before making an appointment, check who the provider is, whether it can offer the boat and whether the data provided is sufficiently reliable. A landlord and tenant are responsible for clear agreements about availability, rental period, deposit, payment method, cancellation, boat license, insurance, transfer and any damage.
6. Purchase, rental, payment and delivery
BotenUnie is not in principle the seller, buyer, landlord or tenant of the offered boat. Any purchase or rental agreements shall be concluded directly between the users concerned. The platform currently does not collect payments or deposits on behalf of other providers and does not confirm any reservations. The individual parties must define what has been agreed.
A purchase or rental agreement may require, inter alia, agreements on ownership, hidden defects, inspection, delivery, liability, deposit, insurance, taxes or any import rules. The legal rights applicable depend on the situation and the law applicable to them.
7. Safety and responsible sailing
The user should verify the rules applicable to the intended route and the specific vessel. Examples include boating certificates, age and experience requirements, safety equipment, insurance, registration, environmental regulations and local restrictions. Data contained in an advertisement come from the provider and do not replace any independent audit or technical advice.
8. Prohibition of use
You may not use the platform for fraud, spam, phishing, intimidation, violation of third party rights, illegal transactions or the publication of false or misleading information. Nor is it permitted to collect large amounts of data without permission or to disrupt the availability, security or normal functioning of the website.
In case of notifications or signals of unlawful content, we may investigate, modify, make inaccessible or delete the ad in question, taking into account the applicable legal obligations and rights of users. Via Contact you may report illegal advertisements or other problems.
9. Photocopiers, texts and other content
By placing material, you declare that you are entitled to use it lawfully. You basically retain your rights to your own content, but give BotenUnie for the duration of the material on the platform, permission to technically store, reduce, show and make accessible within the functions offered. You may not post images or texts of others without permission or other legal basis.
The rights to formatting, software and original editorial content of BotenUnie remain with the respective rightholders. Unauthorized copying or commercial republishing of large parts of the website may be contrary to applicable rights. See also image accounting.
10. Operation, maintenance and modifications
We do our best to keep the website accessible and usable. Maintenance, malfunctions, technical changes or safety measures may temporarily affect the operation. We can change functions and modify texts or form settings. Significant changes which have a substantial impact on users shall be provided, where appropriate, in a timely manner.
11. Information and responsibility
We strive for careful technical operation and offer opportunities to place and search advertisements. However, the content of user ads and the execution of appointments are not continuously independently verified. Users remain responsible for their own statements, actions and agreements.
To the extent permitted by the applicable law, we are not responsible for damage arising solely from incorrect information from another user or from agreements between BotenUnie is not a party. This provision does not exclude any liability that may not be limited by law or legal consumer rights applicable. Consult an expert on important financial or technical decisions.
12. Costs and future services
The platform is currently designed as a private project. There are no fixed subscription rates, mediation commissions or paid placement packages in these conditions. If later paid services are introduced, the relevant prices, payment terms and any required consumer rights shall be indicated separately in advance.
13. Privacy and cookies
For the use of data we refer to the privacy statement and the cookie policy. These documents explain which personal data are processed and how the necessary browser storage works.
14. Applicable law and disputes
To the extent that a choice of law is legally possible, these terms of use are established under Dutch law. Mandatory protection which a user has under applicable law shall be maintained. In case of questions or disputes we ask you first via the contact form contact us so that the problem can be assessed. The legally competent court and any extrajudicial options available shall continue to apply.
15. Amendment of these conditions
